Court: State can’t order unions, companies to reach binding contracts

A California appeals court sided with one of the largest fruit farms in the nation, ruling that a law allowing the state to order unions and farming companies to reach binding contracts was unconstitutional.

Labor activists say the mandatory mediation and conciliation law is a key to helping farm workers improve working conditions.

However, the 5th District Court of Appeal said Thursday it does not clearly state the standards that the contracts are supposed to achieve.

The ruling came in a fight between Gerawan Farming and the United Farm Workers, the union launched by Cesar Chavez. The union won the right to represent Gerawan workers in 1992, but the two sides did not agree to a contract.

At the union’s request, the state Agricultural Labor Relations Board in 2013 ordered Gerawan and the UFW to enter into binding mediation. The two sides couldn’t come to an agreement so a deal was crafted by the mediator and adopted by the labor relations board, the appeals court said. Gerawan objected to the terms.


NC appeals court takes up DNA clearing convicted killer

The court wrangling resumes over whether to free a North Carolina man a judge described as probably innocent despite 20 years in prison on a marred double-murder conviction.

The state Court of Appeals hears arguments Wednesday on whether to free Darryl Howard on bond.

Howard was convicted in 1995 of sexually assaulting and strangling a woman and her 13-year-old daughter.

A Durham judge ruled authorities withheld evidence during Howard's 1995 trial that could have cleared him and that he must be retried.

The judge said new evidence showed possible misconduct in the case by a Durham detective and former Durham prosecutor Mike Nifong, who was disbarred after the Duke University lacrosse case. State investigators determined in 2007 that Nifong lied and withheld evidence proving the innocence of the athletes.

Izard Nobel LLP Announces Class Action

The law firm of Izard Nobel LLP, which has significant experience representing investors in prosecuting claims of securities fraud, announces that a lawsuit seeking class action status has been filed in the United States District Court for the Eastern District of New York on behalf of purchasers of the common stock of Cablevision Systems Corporation between February 16, 2011 and October 28, 2011, inclusive (the "Class Period").

The Complaint alleges that Cablevision and certain of its officers and directors violated the federal securities laws. Specifically, defendants failed to disclose the following adverse facts: (i) that Cablevision was experiencing higher retention and advertising costs; (ii) that Cablevision was losing more video customers than expected, especially in the New York area -- the Company's main service area -- due to increased competition; and (iii) as a result of the foregoing, defendants lacked a reasonable basis for their positive statements about the Company and its prospects.

On October 28, 2011, Cablevision announced its financial results for the third quarter of 2011, the period ended September 30, 2011. On that same day, Cablevision held a conference call with analysts and investors to discuss the earnings announcement and the Company's operations, including the Company's subscriber loss. In reaction to the Company's announcement, the price of Cablevision stock fell $2.17 per share, or 13%, to close at $15.14 per share.
